Suit takes issue with language of redistricting amendment

A lawsuit was filed Monday appealing ballot language approved by the state Board of Elections for a November proposition to establish a redistricting commission.

The legal action was taken by Howard Leib, Susan Lerner, Eric Walker and Eleanor Moretta. It was filed in State Supreme Court in Albany.

Lerner is executive director of Common Cause New York. Her organization is not a named petitioner because only registered voters have standing under election law, the organization said Tuesday in announcing the lawsuit.

“New Yorkers deserve neutral ballot language which fairly describes the amendment,” Lerner said in the statement. “Unfortunately, the wording of Proposition I is intentionally confusing, misleading voters to think that the amendment would create an impartial and independent redistricting process.”

The petitioners are represented by Neil Steiner, a partner at Dechert LLP, a Philadelphia law firm.
