B&L files patent lawsuit against vitamin firm

Claiming willful patent infringement, Bausch & Lomb Inc. has sued Vitamin Health Inc.

In a court complaint filed Monday in U.S. District Court in Rochester, the eye-care company claims a Vitamin Health’s product sold as a preventative against age-related eye disease infringes on its patent on the formula of Bausch & Lomb’s PreserVision AREDS 2 eye-vitamin supplement. 

The formula for Michigan-based Vitamin Health’s Viteyes AREDS 2 product matches the formula specifically described and claimed in the patent Bausch & Lomb secured in 2007 on the PreserVision supplement’s formulation, Bausch & Lomb company claims in the complaint.

The suit seeks an injunction to halt sales of Viteyes and unspecified money damages.
