Former Kodak trademark counsel Stimson joins Nixon Peabody

Eastman Kodak Co.’s top trademark lawyer has moved to Nixon Peabody LLP.

Formerly Kodak’s chief trademark counsel, David Stimson joined Nixon Peabody as a member of the law firm’s brands and creations practice group, Nixon Peabody officials said Wednesday.

As a Kodak in-house attorney, Stimson oversaw the former camera giant’s branding, trademark and copyright legal staff for the last 14 years of a 26-year stint. As Kodak’s trademark legal chief, he also worked closely with its chief marketing officer on worldwide branding strategies.  

Kodak recently won Bankruptcy Court approval to sell a more than 1,000 patent digital imaging portfolio for $527 million. The sale is seen as key to Kodak’s hopes of emerging from the Chapter 11 bankruptcy it filed last year. Kodak had valued the portfolio at $2.6 billion and initially expected to realize more than $1 billion from its sale. A consortium of buyers including Apple Inc., Google Inc. and other technology and Internet giants who otherwise might have bid against each other teamed up to jointly bid on the Kodak portfolio.

Also announced by Nixon Peabody Wednesday is the return Katherine Baynes, public finance attorney, to its Rochester office. She rejoins the firm after a stint at DLA Piper LLP.

Baynes’ credits include helping to secure financing for the completion of the New York Mets’ Citi Field Ballpark and New Jersey Nets’ Barclays Center. She also has served as bond and transaction counsel to industrial development agencies in Suffolk, Westchester, Dutchess and Ontario Counties and New York City.    

The addition of Stimson and Baynes is “a further step in our strategy to expand the capabilities in the Rochester office,” said Carolyn Nussbaum, managing partner of the firm’s Rochester office.
