Bankruptcy filings flat in March

Rochester-area bankruptcy filings last month were exactly level with the same month last year.

Last March and in March 2013, there were 172 new bankruptcy petitions filed in the Bankruptcy Court’s nine-county Rochester division. The Rochester division includes the counties of Monroe, Ontario, Wayne, Livingston, Seneca, Yates, Steuben, Schuyler and Chemung.

The 410 new bankruptcies filed by the end of this year’s first quarter were down from 499 new filings recorded at the same point last year, a 17.8 percent drop.

Last month’s new filings included 137 Chapter 7 cases, 35 Chapter 13s and no Chapter 11 filings.

Chapter 7 filers seek to discharge debts by liquidating assets to create a fund to pay creditors anywhere from zero to 100 percent of amounts owed.

Chapter 13 petitioners make plans to pay creditors some or all of what they are owed in as many as 60 monthly installments.

Chapter 11 filers—most often businesses looking to restructure under court protection—also make plans to fully or partly pay creditors.
